View Full Version : park+cops = hypothetical

hypothetically speaking, if your in a group that is drinking in a park be it legally or illegally (eg age 17) and the cops show up, naturally everybody's first instinct would be to run.
the question is, is there actually any reason to? what can the cops do to you if u just drop ur can and say u hadnt had anything to drink?
ps this isnt a thread for throwing out tales of daring escapes etc, its just a hypothetical thread of the consequences etc.

well probably not bad enough to test fate haha, i was just interested as to what they could do to you if you happen to be in a park with alcohol in the vasinity but nothing actually on you.

i got a $22 fine for having a case they confiscated it and i just had to get a parent to go to the station and collect it
i wasn't drunk but they didn't breath test me. The charge was like minor obtaining alcohol in a public place.

that's what i was thinking. but it really depends where ya live and what the cops are like. we have a real problem with vandalism here and the cops them selves said they don't really pick on underage drinkers as long they don't cause trouble.

Cops aren't completely stupid. You're going to have to work a little bit harder than that if you want to put one over on them.
Or, you could accept that underage drinking is against the law, and that your actions are going to have consequences. Trying to avoid or weasel out of the consequences of your actions is a sign of immaturity.

If there's anything the cops hate it's an unsporting prey. If you don't run and stand there stinking of drink they will more than likely see it as a major insult, hit you with pepper spray, beat you and then possibly lock you up in the really dodgy cells with the murderers, rapists and the french.
Running away on it's own is alright but you've gotta remember the boys in blue like a bit of sport in their friday night shift so proper ettiquette dictates that you should at least throw a brick through their windshield first before then baring your arse at them and shouting "C'MON YA FUCKING PANSIES! ALL COPPERS ARE FILTHY PAEDOPHILES!"
This of course is polite police terminology for "good sport, old chap, I'll wager you can't catch me" The cops are then duty bound to give chase in a gentlemanly fashion for at least 15 minutes with the loser (i.e yourself if you're caught or the constabulary if they fail to catch you) being forced to pay for the pot of tea and the oranges at the end of proceedings.
It's a rite of passage for both the young lad about town and the new bobby on the beat and also a bit of nostalgia for the older PCs. I highly recommend it!

As opposed to any other drink related behaviour? ;)

This annoys me. The whole 'you can't' touch me copper, we've done nothing' is pretty annoying. Kids should be scared of cops, period.

its not about whether they believe you have been drinking or not, i would assume it to be rather obvious. More the 'innocent untill proven guilty beyond reasonable doubt' approach. Can they legally breathalise you if your under 18? will they do more than pour out the grog and tell you to move along?
as for weaseling out of actions being a sign of immaturity i would say it more a sign of intelligence and cunning. As stated above a 'right of passage' to give them a good chase be it metaphorical or literal.

First thing they do when pulling over a red P plater is whip out the bretho. I assume they can do the same if you're not driving a vehicle.

im not retarted lol, but whether or not to stand and accept punishment or just make a run for it would decide on the consequences, which i am here trying to determine, hypothetically...
if a quick bolt saves me a $500 fine and a phone call home then ill be proud to wear the big sticker that says 'immature'

If my dad found out i was getting pissed (which I'm not)at the skatepark (waurn ponds) he would throw me through the wall and kick me out of home.

If the police walked into a park, and found a group of underage people standing around, near a bunch of beer cans, wouldn't you say that they would have reasonable suspicion that you had comitted an offence?
Police don't have to have "beyond reasonable doubt" to act, because police don't convict people. They merely charge people. It's the courts decision as to whether or not your guilty.

Most cops will poor it out, if I was you i'd be more worried about who bought it for you. The Fines/jail time they get actually matters, worst you'll get for drinking underage is a $225 fine (as far as I know).
But if you run and get caught you'll probably go to court. yaayyyy
Just for the record, this is knowledge I've gained over time, may not be correct ;)
What exactly is so important about drinking in this park rather than say, one that you're not going to get caught in?
If there's anything the cops hate it's an unsporting prey. If you don't run and stand there stinking of drink they will more than likely see it as a major insult, hit you with pepper spray, beat you and then possibly lock you up in the really dodgy cells with the murderers, rapists and the french.

My work in youth services sees me listen to this a fair bit.
Most likley, they will give you a caution and tell you to move on. If they suspect you have been drinking, they have to take you home or secure your safety by a night in a cell (duty of care). Then usually leave it up to your folks to deal with.
If you run, it will most likley end up with a formal caution or court appearence.
Tip: Most cops were young once, treat them with respect and they will show you the same...

Running is immature. You may get away with it but karma will get you back.
In the situations I've been in the Police will simply tell you to pour all your drinks out then they will whack you with a $225 fine even if the drinks are unopened (because you're underage). They have only ever fined the people they catch with drinks on them and not the people that have managed to get rid of it quick enough. All they do then is take everyone details and unless you're being a nuisance and causing trouble they will simply tell you to have a good night and leave you alone to find the drinks you chucked and keep on drinking them. As someone said earlier in the thread, treat them with respect and they will do the same back.

if its the liquor police its only a $75 fine. rules. pretty sure the hotel we were outside of with our drinks got an epic fine though. they were not pleased at all when we came back in and got more drinks when they were going through their premises checking everything out. sucks to be a dodgy hotel with no security. so many nights where half the crowd where underage and drunk as shit and buying drinks.

In Victoria police can't confiscate unopened alcohol off you no matter where you are. As for if you are drinking it, I don't know. I've hit the piss in public parks many times, but this was at like between 12 and 5 in the morning so there weren't many people to call the cops on us.
Play it safe and you'll be fine. Just make sure you don't make too much noise or be fuckwits and no one should report you.

Speaking from real experience: No point running unless you are an a)dumbass or b) doing something in the park much more illegal than just drinking.
When the cops come over, if they are in a bad mood they will just poor out your alcohol onto the ground, and tell you to move on.
If they are in a good mood they will let you continue what you are doing as long as you arent causing a ruckus or littering in the park.
But usually the only reason cops would enter the park would be because you are causing a nuisance or someone called them in.
We got told by some encouragement guy that was a copper that the fine for underage drinking was *$20 and I think it was the same for being intoxicated on the street. But if its an alcohol free zone then its around $100+ I think.
*disclaimer - all facts and amounts of money for fines may not be correct.

Two fines:
Drinking in a public place, and
Underage drinking.
Though there more likely to send you to a seminar about drinking than fine you.

As if you'd get caught/stay in one place long enough to be done by the police for drinking in public.
I thought the whole idea about drinking on the streets underage was the adventure, not just propping yourself in a park for the night?
